Introduction
FlexWerk values your privacy. We treat privacy-sensitive information of our website visitors, candidates, employees and self-employed workers with the utmost care and security. In this privacy statement, we inform you how FlexWerk handles your personal data in accordance with the General Data Protection Regulation (AVG).
Who are we?
When we refer to ‘FlexWerk’ in this privacy statement, we mean the private company with limited liability Flex Werk B.V., based at Pampuslaan 140, 1382 JR in Weesp.
FlexWerk is a processor within the meaning of the AVG. This means that we are authorised to process personal data and to determine the purposes and means of such processing. Sometimes FlexWerk engages other companies to perform services for it. Even in these situations, we remain responsible for processing your data. In that case, we make contractual agreements with the party on how to handle the data so that your privacy remains guaranteed.
Technical information
When you visit our website, the website automatically collects information about you and the device you use to visit the website. This includes, for example, the IP address of your device, the IP address of your Internet Service Provider, the operating system you use, the date and time of your visit, the Internet address of the website from which you linked directly, the pages you visited and the information you viewed on the website, your location and the material you send to and download from the website. We use this technical information to administer the website and improve the quality and effectiveness of our website.
Cookies
FlexWerk uses cookies and web statistics. This allows us to see how visitors use our website and to better adapt the website to your user preferences. Cookies are small pieces of information stored on your computer. On your next visit to our website, these small pieces of information are recognised, making your visit easier. These cookies are anonymous and do not contain any personal data.
When do we collect your personal data?
We retain and process your data if:
- you have given FlexWerk permission to process your personal data for one or more specific purposes;
- the processing is necessary for the performance of an agreement to which you are a party, or to take measures at your request prior to the conclusion of an agreement;
- the processing is necessary to comply with a statutory obligation to which FlexWerk is subject;
- the processing is necessary to protect your or another person's vital interests;
- the processing is necessary for the performance of a task in the public interest or a task in the exercise of public authority vested in FlexWerk;
- the processing is necessary to safeguard the legitimate interests of FlexWerk or a third party. This does not apply if your interests or the fundamental rights and freedoms that move to protect your personal data outweigh those interests.
Why do we collect your personal data?
Your personal data are used to provide the best possible HR services offered to you. These services include, for example, temping, secondment, mediation, payroll, payroll administration, personnel management, personal development and employability and recruitment & selection.
FlexWerk uses your data to:
- match labour market supply and demand;
- inform you of interesting offers of products and services of FlexWerk and third parties;
- register hours worked and process them in our payroll system;
- assess your suitability and availability in connection with mediation for (permanent or temporary) work or an assignment, approach you for commercial offers, newsletters and promotional campaigns that may be of interest to you, only if you have signed up for these (opt-in);
- enter into an employee or staff placement relationship with you, maintain it and carry out the relevant administration for this;
- fulfil our reintegration obligations and comply with (the government-imposed) goal of helping people with a large(er) distance to the labour market find work;
- record an assignment with the client in an agreement and maintain and fulfil it;
- process data for our clients as part of a pre-employment screening;
- promote your personal development and employability, for example through training, education and testing;
- provide for management purposes, such as management information, the provision of internal controls and corporate security and the conduct of audits and auditing;
- provide for quality purposes, such as certification;
- apply for subsidies, premium discounts, etc;
- comply with laws and regulations when entering into an employee or staff placement relationship, including (but not limited to) identification, labour legislation, tax and social security legislation, combating fraud and national and international sanctions legislation.
What personal data do we collect?
Depending on the relationship between you and FlexWerk, we collect different types of information. Below you will find the personal data we process for each relationship. You are responsible for providing your personal data correctly and keeping them up to date.
Job seeker or candidate
- Name details, e-mail address, telephone number and other contact details.
- Birth details, age and gender.
- Curriculum vitae (CV) and information about education, internships and work experience.
- Data on training, education and/or tests you have attended / taken yourself or through us.
- Data on availability and leave.
- Other data that (may) be important to assess the suitability of the candidate, such as references, certificates and data on work experience.
- On a voluntary basis, other content introducing yourself, such as a photo or video.
- Data other than those mentioned above whose processing is necessary for the purposes of the law.
Seconded, (temporary) employee or self-employed person
- Name details, e-mail address, telephone number and other contact details.
- Birth details, age and gender.
- Curriculum vitae (CV) and information on education, internships and work experience.
- Data on training, education and/or tests you have attended / taken yourself or through us.
- Data on availability and leave.
- Nationality, BSN, copy of identity document and any work permit.
- Data to enable a pre-employment screening.
- Data on the nature and content of previous job placements and their termination.
- Other data that are or may be important to assess the suitability of the candidate, such as references, certificates and data on work experience.
- Other data related to personnel, salary and absence registration.
- On a voluntary basis, other content introducing yourself, such as a photo or video.
- Data other than those listed above whose processing is necessary for the purposes of the law.
Third parties
FlexWerk may disclose your data to third parties if necessary. These include other entities of FlexWerk B.V., our clients, subcontractors providing services or carrying out assignments on behalf of FlexWerk, suppliers, government agencies and other business relations. We may also be required to do so by, for example, a court order or judgment. Personal data is provided on the basis of a legitimate interest, legal obligation and/or to perform the agreement according to the purposes mentioned under ‘Why do we collect your personal data?’.
Your rights
It is important to us that you can easily exercise your rights regarding the processing of your personal data. Below you will find all the rights that may apply to you. If you want to claim these, you can easily contact us.
View or change data
You can always send an e-mail to administratie@flex-werk.eu to ask which (categories of) data of yours we process, for which purposes we do this, from which source the data originate and how long we keep the data. You can also contact us to supplement, correct or delete your data. If we have unexpectedly provided you with incorrect personal data, we will of course correct this. If we have changed your personal data, we will notify you.
Restricting the processing of your data
Do you disagree with the content of the data we hold on you? Then you can submit a request to temporarily restrict the processing of your data. To do so, simply send an e-mail to administratie@flex-werk.eu. We will then wait to distribute your data until, in your opinion, it is back in order. If we restrict the processing of your data, we will notify you.
Transferring data
You are completely free to transfer your personal data to third parties. To do this, you can simply request the data we hold on you at administratie@flex-werk.eu. You will then receive them in a structured, common and machine-readable form.
Right to be forgotten
If you no longer wish to use our services, you can request that we delete all your personal data. To do so, simply send an e-mail to administratie@flex-werk.eu.
You can also revoke any granted consent to process your data at any time. We will then stop processing the personal data for which you had granted consent. This does not affect processing operations that have already taken place.
Procedure, response time and costs
We try to process the requests mentioned above as soon as possible, but at the latest within one month. We are required to verify your identity before we can process your request. Requests are processed electronically, unless this is not possible or you wish otherwise.
In principle, we will not charge you for processing the aforementioned requests, unless your requests are excessive, manifestly unfounded or if you request additional copies when exercising the right of inspection.
Security
FlexWerk makes every effort to optimally secure your personal data against unlawful use. We do this by means of physical, administrative, organisational and technical measures. For example, only authorised persons have access to the data. If data are provided to third parties that provide services or carry out assignments on behalf of FlexWerk, we have agreed with them that they will also optimally secure the personal data.
Retention period
We do not retain personal data longer than necessary for the purpose of processing and in accordance with the statutory retention periods.
For job seekers, candidates or business relations with whom we have not yet concluded an agreement: by agreeing to this privacy statement, you grant us permission to keep your data for one year.
Questions, comments or complaints
We make every effort to handle your personal data as well as possible. Nevertheless, do you have any questions, comments or complaints about FlexWerk's protection of your data? Please contact us in writing or send an e-mail to administratie@flex-werk.eu.
If you disagree with FlexWerk's use of your personal data, you can also lodge a complaint with the Dutch Data Protection Authority.
Data breach
Is there a (suspected) data breach? Please report this immediately via administratie@flex-werk.eu.
Changes
FlexWerk reserves the right to amend this privacy statement. The provisions in this statement are not intended to create any obligation or agreement between FlexWerk and a data subject.
Other provisions
The provisions of this privacy statement and any dispute arising therefrom shall be governed by Dutch law.
